I hereby make formal representations against the above Penalty Charge Notice on the following grounds:

GROUNDS FOR APPEAL

1. No Obstruction of the Box Junction

The driver was briefly held by stationary traffic ahead while waiting to complete a right turn, as permitted under paragraph 11(3) of Schedule 9, Part 7 of the Traffic Signs Regulations and General Directions 2016. The vehicle was not obstructing the approach to the box junction and the stop was incidental to the flow of traffic.

I relied on the right-turn exemption set out in TSRGD 2016 Sch 9 Part 7 Para 11(3): "a vehicle waiting to turn right may enter the box if its exit path is blocked by oncoming traffic which it cannot avoid."

There is no evidence on the ticket that the CE Officer assessed whether this exemption applied before issuing the notice. The absence of such an assessment renders the enforcement action procedurally defective.

2. Procedural Defect - Failure to Assess Exemption

The Penalty Charge Notice for a box junction contravention must demonstrate that the officer considered the statutory exemptions before issuing the notice. The PCN as served makes no reference to any such assessment. See case 2210739628 (Westminster) where a similar failure led to dismissal.

3. Questionable Box Design / Signage

The box junction at Marylebone Bone does not have clearly marked edges on the northern approach, and the approach signage was partially obscured by tree growth at the time. I attach a photograph (exhibit A) showing the condition of the signage. If the driver cannot reasonably be expected to identify the extent of the controlled area, the enforcement is unsound.

CONCLUSION

On the facts as they stand, the issuance of this PCN is not supported by the statutory basis. I request that the notice be cancelled.
